Terms of Service

Terms of Service

1voice.us — Effective October 1, 2026

Welcome to 1voice.us ("1voice," "we," "us," or "our"), a social network built on the belief that the free and open exchange of ideas makes us all stronger. These Terms of Service ("Terms") are a legally binding agreement between you and the operator of 1voice.us. They govern your access to and use of the 1voice website, mobile and desktop applications, APIs, and related services (together, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Acceptance of the Terms
These Terms form a contract between you and 1voice. We may update these Terms from time to time as described in Section 18. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher) to create an account or use the Services. By using the Services, you represent and warrant that you meet this requirement and are not barred from using the Services under applicable law. Our Services are not directed to children, and we do not knowingly collect information from anyone under 18.

Note: this document is a starting draft of enforceable Terms of Service. Have a licensed attorney in your jurisdiction review and finalize it before publishing it on 1voice.us.

3. Your Account
Accuracy: when you register, provide accurate, current, and complete information, and keep it up to date.

One account per person: each individual may maintain one account unless we expressly permit otherwise in writing.

Security: you are responsible for safeguarding your credentials and for all activity that occurs under your account. Use a strong, unique password and enable any security features we offer.

Unauthorized use: notify us promptly at support@1voice.us (confirmed placeholder - replace with the actual support contact) if you believe your account has been compromised. We are not liable for losses caused by unauthorized use of your account.

4. Our Approach to Free Speech
1voice exists to protect open discourse. We take a viewpoint-neutral approach to moderation: we do not remove content or restrict users because of political, religious, or social opinions. Wherever the law allows, speech stays up - even speech we or others may find unpopular. Our rules below are limited to what the law requires and what keeps the platform functional and safe for everyone.

Freedom of expression does not shield unlawful conduct. The following categories of content and behavior are never permitted on the Services, and may result in content removal, account suspension, or permanent termination:

Illegal activity: content that violates any applicable law, or that facilitates crime, fraud, or wrongdoing.

Child safety: child sexual abuse material (CSAM) or sexual exploitation of minors. We report violations to the National Center for Missing & Exploited Children and law enforcement.

Credible threats: true threats of violence or content that incites imminent violence.

Non-consensual private information: publishing someone's non-public personal data (e.g., home address, phone number, financial details) with intent to harm or harass.

Impersonation and deception: impersonating others or misrepresenting your identity or affiliation in a misleading way.

Spam and abuse: unsolicited bulk or automated messages, artificial amplification, scraping, or other behavior that degrades the Services.

Malware and hacking: distributing viruses or malware, interfering with the Services, or attempting unauthorized access.

Infringement: content that infringes the intellectual property or other rights of others (see Sections 7-8).

Circumvention: attempting to evade enforcement, including by creating new accounts to bypass a suspension.

For reports of alleged violations, write to moderation@1voice.us (confirmed placeholder - replace with the actual contact). We review reports against this section only, and we do not guarantee that any reported content will be removed.

5. Your Content
"Your Content" means text, images, video, audio, profiles, comments, and other material you submit to, post, or otherwise make available through the Services. You retain all ownership rights in Your Content.

By posting or uploading Your Content, you grant 1voice a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, reproduce, distribute, display, transmit, modify (for technical processing and formatting), and create derivative works of Your Content solely as needed to operate, improve, and promote the Services. This license continues for as long as Your Content remains on the Services and for a reasonable archival period thereafter.

Your responsibility: you are solely responsible for Your Content and represent that you have all rights needed to post it and that it does not violate these Terms or the law.

Feedback: suggestions and feedback you provide about the Services are voluntary; you grant us the right to use them without restriction or compensation.

Deletion: you may delete Your Content at any time through the account tools we provide. Content shared or reposted by others may persist outside your control after deletion.

6. 1voice Intellectual Property
The Services, including their software, design, logos, graphics, and text (other than Your Content), are owned by 1voice and its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works of the Services except as permitted by law or with our written permission.

7. Copyright and DMCA
We respect intellectual property and comply with the Digital Millennium Copyright Act ("DMCA"). If you believe material on the Services infringes your copyright, our designated agent may be reached at dmca@1voice.us (confirmed placeholder - replace with the actual registered agent contact). A valid notice must include: (1) identification of the copyrighted work; (2) identification of the infringing material and its location; (3) your contact information; (4) a good-faith statement; (5) a statement, under penalty of perjury, that you are authorized to act; and (6) your physical or electronic signature. Misrepresentations may subject you to liability, including attorney's fees.

We will process valid notices, notify affected users where practical, and maintain a policy of terminating the accounts of repeat infringers where appropriate.

8. Third-Party Content and Links
User-generated content on the Services is the responsibility of the person who posted it, not 1voice. We do not endorse, verify, or guarantee the accuracy of user content, and you rely on it at your own risk. The Services may contain links to third-party websites or integrations; we are not responsible for third-party content, policies, or practices, and your dealings with third parties are solely between you and them.

9. Fees and Paid Features
Free access: the basic Services are currently free. We may introduce paid features, subscriptions, or digital goods in the future.

Charges: if you purchase a paid feature, you agree to pay the stated fees. Subscriptions renew automatically at the then-current price until cancelled.

Cancellation and refunds: you may cancel a subscription at any time; cancellations take effect at the end of the current billing period. Fees are non-refundable except as required by law or as we state for a specific offering.

App stores: purchases made through an app store are governed by that store's terms; contact the store for billing issues.

Taxes: fees are exclusive of taxes, which you are responsible for paying.

10. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you consent to our processing of information as described there.

11. Service Modifications and Beta Features
We may add, modify, or discontinue features of the Services at any time, with or without notice. New or experimental features (including any AI-powered features, assistants, or streaming/messaging modules) are provided "as is" and may be incomplete, inaccurate, or unavailable; do not rely on their output for critical decisions.

12. Suspension and Termination
You may delete your account at any time through the Services' account settings. We may suspend or terminate your access if you violate these Terms, if required by law, or, in our reasonable discretion, to protect the Services or others. Surviving provisions include Sections 5 (as to limits on Your Content license), 7, 8, 13, 14, 15, 16, 17, 19, and this paragraph. Termination does not relieve you of fees already owed.

13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Services will be uninterrupted, error-free, or secure; that defects will be corrected; or that any content, including user content or AI-generated output, is accurate, complete, or reliable. Your use of the Services is at your sole risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL 1VOICE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). The limitations in this section apply even if a limited remedy fails of its essential purpose.

15. Indemnification
You agree to indemnify, defend, and hold harmless 1voice and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to: (a) Your Content; (b) your use or misuse of the Services; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party. We may assume the exclusive control of any defense at our expense, and you agree to cooperate with us.

16. Dispute Resolution
(a) Informal resolution. Before filing a claim, the parties will attempt to resolve the dispute informally by sending a written description of the dispute to the contact in Section 20 and negotiating in good faith for thirty (30) days.

(b) Binding arbitration. If the dispute is not resolved informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as provided below. The arbitration will take place in the state of [GOVERNING STATE] or, at your option, remotely. You and 1voice waive any right to a jury trial and to participate in any class, collective, or representative action.

(c) Opt-out. You may opt out of binding arbitration by sending written notice to the contact in Section 20 within thirty (30) days of creating your account, stating your name and intent to opt out.

(d) Exceptions. Either party may bring an action in small claims court, or seek temporary or preliminary injunctive relief in court to protect intellectual property or confidentiality, without first arbitrating. Claims subject to 47 U.S.C. Section 230 or otherwise dismissed under law may be resolved on the papers.

17. Governing Law
These Terms are governed by the laws of the state of [GOVERNING STATE], excluding its conflict-of-laws rules. Any claim brought in court must be brought in the state or federal courts located in [VENUE COUNTY/CITY], and you consent to their exclusive jurisdiction, except as provided in Section 16.

18. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the Services and updating the "Effective" date above, and we may provide additional notice by email or in-app message. Your continued use of the Services after the changes take effect constitutes acceptance. If you do not agree to updated Terms, you must stop using the Services.

19. General Provisions
Entire agreement: these Terms, together with the Privacy Policy and any other policies we publish, are the entire agreement between you and 1voice regarding the Services.

Severability: if any provision is found unenforceable, the remaining provisions remain in full force and effect.

No waiver: our failure to enforce any provision is not a waiver of our right to do so later.

Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Headings: section headings are for convenience only and have no legal effect.
